OVERVIEW

Welcome to Mama Social Club. The terms “we”, “us” and “our” refer to Mama Social Club.

We operate this website and online store, including all related content, products, features and services (together, the “Services”). The Services are hosted and supported by Shopify, which provides the technical platform enabling us to sell our products to you.

These Terms of Service (“Terms”), together with any documents expressly incorporated by reference (including our Privacy Policy and Refund Policy), set out the legally binding agreement between you and us governing your use of the Services.

By accessing, browsing, or purchasing from our Services, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the Services.

Nothing in these Terms affects your statutory rights under UK or EU consumer law.

SECTION 1 – ELIGIBILITY, ACCESS AND ACCOUNT SECURITY

You must be at least 18 years old to place an order through our Services.

You may browse the Services without creating an account. Where account creation is required, you agree to provide information that is accurate, current and complete and to keep it updated.

You are solely responsible for:

  • Maintaining the confidentiality of your account credentials

  • All activities carried out under your account, whether authorised by you or not

We reserve the right to suspend or terminate accounts where we reasonably believe there has been misuse, fraud, or breach of these Terms.

Accounts are personal to you and must not be transferred, sold, assigned or shared.

SECTION 2 – PRODUCTS AND DESCRIPTIONS

We take reasonable care to ensure product descriptions, images and pricing are accurate at the time they are displayed.

However:

  • Colours and appearance may vary depending on your device and display settings

  • Images are for illustrative purposes only

  • Minor variations do not constitute a defect

All products are subject to availability. We reserve the right to withdraw or amend products, descriptions or specifications at any time without liability.

Nothing in this section limits your statutory rights where a product is faulty, misdescribed or not fit for purpose.

SECTION 3 – ORDERS AND CONTRACT FORMATION

By placing an order, you make an offer to purchase products.

A legally binding contract is formed only when we dispatch your order and send you a dispatch confirmation. Order confirmation emails acknowledging receipt do not constitute acceptance.

We reserve the right to refuse or cancel orders, including but not limited to where:

  • Products are unavailable

  • Pricing or description errors are identified

  • Fraud or unauthorised activity is suspected

If an order is cancelled before dispatch, any payment taken will be refunded using the original payment method.

Orders placed are for personal, non-commercial use only. We reserve the right to cancel orders that appear to be for resale or commercial exploitation.

SECTION 4 – PRICES, TAXES AND PAYMENT

All prices are shown in GBP unless otherwise stated.

Prices include VAT where applicable, unless clearly stated otherwise. Delivery charges, customs duties and import taxes (where applicable) are shown at checkout and are your responsibility.

We reserve the right to change prices at any time, but changes will not affect orders already accepted.

You confirm that you are authorised to use the payment method provided and that sufficient funds are available. We are not responsible for delays or losses caused by payment provider errors.

SECTION 5 – DELIVERY AND RISK

Delivery times are estimates only and are not guaranteed.

We are not responsible for delays caused by events beyond our reasonable control, including but not limited to courier delays, customs processing, strikes, or adverse weather.

Risk passes to you upon delivery to the address provided.
Title to goods passes once full payment has been received.

If an item is lost in transit, you must notify us within a reasonable time so we can investigate with the carrier.

SECTION 6 – CANCELLATIONS, RETURNS AND REFUNDS

Your rights to cancel, return and obtain a refund are governed exclusively by our Refund Policy and applicable consumer law.

Nothing in these Terms restricts your statutory right to cancel under the Consumer Contracts Regulations (UK/EU), except where an exemption lawfully applies (for example, personalised or hygiene-sealed items once opened).

Refunds will only be issued to the original payment method.

SECTION 7 – INTELLECTUAL PROPERTY

All content on the Services, including text, images, designs, logos, trademarks, videos and software, is owned by or licensed to Mama Social Club and is protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access the Services for personal, non-commercial use only.

Any unauthorised use, reproduction or distribution is strictly prohibited and may result in legal action.

SECTION 8 – THIRD-PARTY SERVICES AND LINKS

The Services may contain links to third-party websites or tools.

We are not responsible for the content, accuracy, availability or practices of third-party services. Your use of third-party services is entirely at your own risk and subject to their terms.

SECTION 9 – SHOPIFY PLATFORM DISCLAIMER

Mama Social Club operates independently from Shopify. All sales contracts are between you and Mama Social Club.

Shopify bears no responsibility or liability for any purchase, dispute, injury, loss or claim arising from transactions made through our store.

SECTION 10 – PRIVACY AND DATA PROTECTION

Personal data is processed in accordance with our Privacy Policy and applicable UK GDPR and EU GDPR legislation.

By using the Services, you acknowledge that your data may be processed by Shopify and service providers acting on our behalf.

SECTION 11 – USER CONTENT AND FEEDBACK

By submitting reviews, feedback or other content, you grant us a perpetual, irrevocable, royalty-free licence to use, reproduce and display such content for lawful purposes.

You confirm that any content you submit:

  • Is accurate

  • Does not infringe third-party rights

  • Complies with applicable law

We reserve the right to remove content at our discretion.

SECTION 12 – ERRORS AND OMISSIONS

We reserve the right to correct errors or omissions and to cancel orders affected by such errors, including pricing or availability mistakes.

Where cancellation occurs, a full refund will be provided.

SECTION 13 – PROHIBITED USE

You must not misuse the Services, including attempting fraud, interfering with site functionality, infringing intellectual property, or engaging in abusive or unlawful conduct.

We reserve the right to restrict or terminate access where misuse is identified.

SECTION 14 – TERMINATION

We may terminate or suspend access to the Services at any time where there is a breach of these Terms or suspected unlawful activity.

Termination does not affect accrued rights or liabilities.

SECTION 15 – DISCLAIMER OF WARRANTIES

Nothing in these Terms excludes or limits warranties that cannot be excluded under consumer law.

Subject to that:

  • The Services are provided “as available”

  • We do not guarantee uninterrupted or error-free operation

SECTION 16 – LIMITATION OF LIABILITY

Nothing in these Terms limits liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Any liability that cannot be excluded by law

Subject to the above, our total liability shall be limited to the value of the products purchased.

We are not liable for indirect, incidental or consequential losses.

SECTION 17 – INDEMNITY

You agree to indemnify us against losses arising from your breach of these Terms or misuse of the Services.

SECTION 18 – SEVERABILITY

If any provision is held unenforceable, the remainder will remain in full force.

SECTION 19 – ENTIRE AGREEMENT

These Terms, together with referenced policies, constitute the entire agreement between you and us.

SECTION 20 – ASSIGNMENT

We may assign these Terms without notice. You may not assign your rights without our consent.

SECTION 21 – GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of England and Wales.

UK consumers may bring proceedings in UK courts.
EU consumers may bring proceedings in their country of residence.

SECTION 22 – COMPLAINTS, ADR AND ODR

22.1 Internal Complaints Handling

We aim to review complaints promptly and seek to resolve disputes amicably without the need for formal proceedings.

22.2 Alternative Dispute Resolution (UK Consumers)

Under the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015, we are required to inform UK consumers about the availability of Alternative Dispute Resolution (“ADR”).

We are not obliged to use, nor do we commit to participating in, an ADR scheme.

If a dispute cannot be resolved through our internal complaints process, you may be entitled to refer the dispute to an approved ADR provider. Information about approved ADR bodies can be found at:

Nothing in this section affects your right to bring legal proceedings.

22.3 Online Dispute Resolution (EU Consumers)

If you are a consumer resident in the European Union, you may submit a complaint via the European Commission’s Online Dispute Resolution (“ODR”) platform:

22.4 No Waiver of Rights

Participation in ADR or ODR is voluntary and does not limit or replace your statutory rights to pursue court proceedings.

SECTION 23 – CHANGES TO TERMS

We may update these Terms to reflect legal or operational changes. Material changes will be notified where required by law.

Continued use of the Services constitutes acceptance of updated Terms.
